TCPA Terms & Conditions

1. Acceptance of Terms
By providing your telephone number to Smokey Mountain Trailers (“Company,” “we,” “us,” or “our”) and opting in to receive text messages (SMS/MMS) or calls, you agree to these TCPA Terms & Conditions, which form a binding agreement. If you do not agree, do not opt in to receive our communications.
2. Scope
These TCPA Terms & Conditions govern your consent to receive text messages and calls from us, including messages sent via autodialer, prerecorded/automated voice messages, or live calls. They do not replace any other agreements or terms covering general use of our website or business services; rather, they supplement those agreements where TCPA compliance is concerned.
3. Consent Requirements
- Voluntary Consent: Your consent to receive marketing text messages or calls is entirely voluntary. You may continue to transact with us without providing such consent.

5. Opt-Out / Revoking Consent

- Effect of Opt-Out: Opting out of marketing messages does not affect other (non-marketing) communications you may receive, such as transactional or informational calls or texts (e.g., final billing inquiries, scheduling information).

7. Fees & Charges
We do not charge you for sending or receiving text messages; however, your carrier’s message and data rates may apply. You are responsible for any such charges.
8. Disclaimer of Warranties & Liability
- We provide our text messaging and calling services “as is” without warranties of any kind.
- To the fullest extent permitted by law, we disclaim liability for any claims, damages, or losses arising out of or relating to your participation in our calling or SMS program.
9. Changes to Terms & Conditions
We reserve the right to modify these TCPA Terms & Conditions at any time. If we do so, we will post the updated version on our website with a new effective date. By continuing to receive or request text messages or calls from us after changes are posted, you agree to the updated Terms & Conditions.
10. Governing Law
These TCPA Terms & Conditions are governed by the laws of the State of Tennessee, without regard to conflict of law rules. Any disputes arising under or relating to these Terms shall be brought in the state or federal courts in Tennessee.
